PLEASE READ THESE TERMS OF USE CAREFULLY. BY ACCESSING OR USING UPUMP™ ("THE SERVICE"), YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.

1. Independent Service

UPump™ is an independent app not affiliated with Costco Wholesale.

2. Informational Purpose & Price Disclaimer

• General Information Only: UPump displays public and community-reported fuel prices for general informational purposes only.
• Indicative Pricing: Fuel prices, taxes, and availability change rapidly. Displayed prices are indicative estimates only and may differ from physical pump prices.
• Verification Duty: It is your responsibility to verify the physical posted price at the pump prior to refueling. Prices are displayed in Canadian Dollars ($ CAD) per litre, inclusive of applicable taxes.

3. Operational Safety & Distracted Driving

• Compliance with Laws: You agree NOT to interact with UPump while operating a motor vehicle. You must strictly comply with all provincial traffic statutes, including the Ontario Highway Traffic Act, R.S.O. 1990, c. H.8, and equivalent provincial legislation.
• Zero Liability for Misuse: The developer disclaims all responsibility for traffic fines, motor vehicle accidents, personal injuries, or property damage resulting from illegal or unsafe mobile device use while driving.

4. Non-Affiliation & Trademark Notice

UPump is an independent project and is NOT affiliated with, associated with, authorized by, endorsed by, or in any way officially connected with Costco Wholesale Corporation, Costco Wholesale Canada Ltd., or any of their subsidiaries. "Costco" and related marks are registered trademarks of Costco Wholesale Corporation. Usage of third-party names within the app constitutes nominative fair use for descriptive identity purposes only.

5. Intellectual Property

All code, custom visual designs, logos, and UI layout within UPump remain the exclusive property of the developer.

6. Disclaimer of Warranties & Limitation of Liability

• "As-Is" Service: The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind.
• Liability Cap: To the maximum extent permitted by applicable Canadian law, UPump, its operator, and its developer shall NOT be liable for any direct, indirect, incidental, or consequential damages (including extra driving costs, fuel expenses, or lost time) arising from your use of or reliance on the Service.
• Maximum Recoverable Amount: The developer's total aggregate liability under any circumstance is strictly limited to $0.00 CAD.

7. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any legal disputes shall be brought exclusively in the courts located in Ontario, Canada.
